These Terms govern the Zen Whisper Mac application (the "App") provided by ZENPRODUCTS TECHNOLOGIES PRIVATE LIMITED, trading as ZENPRODUCTS ("we," "us," or "our"). Website: www.zenproducts.ai. Contact: hello@zenproducts.ai.
By downloading, installing, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
1. The App
Zen Whisper provides Mac dictation and transcription features, including speech-to-text at your cursor, transcription of audio you import, and transcription of audio obtained from supported YouTube and Instagram links. Default speech recognition is designed to run on your Mac with downloaded speech packs. Optional cloud speech and writing tools may be available if you supply your own API keys.
The App requires a compatible Apple Silicon Mac and a supported macOS version as stated on the product page. Features and language packs may change over time.
2. Trial, free tier, and paid licenses
A time-limited Pro trial may start on your first successful transcription, not merely at install. After the trial, without a paid license, the App may continue with a free weekly word allowance for transcription, with some Pro writing features turned off, as described in the App and on the product page. Exact limits may change; the App shows the current rules.
Paid seats and lifetime licenses are sold through Gumroad (or another storefront we designate). License activation and validation may use our license service and may bind seats to devices as described in the App. Refunds and purchase disputes for storefront purchases follow that storefront's rules.
3. Your responsibilities
- You are responsible for content you dictate, import, or transcribe.
- You must have the right to process any file or link you import, including media from third-party platforms.
- You are responsible for API keys and usage charges with any cloud provider you enable.
- You must keep license credentials confidential and not share seats beyond what your license allows.
4. Acceptable use
You may not use the App unlawfully, attempt to bypass licensing, interfere with the App or related services, or use it to access accounts or content you are not authorized to use.
5. Third-party services
Gumroad, cloud AI providers, model hosts, analytics endpoints, update hosts, and social platforms you contact through imports have their own terms. We are not responsible for those services.
6. Intellectual property
The App, branding, and related materials are owned by us or our licensors. You retain rights in your own content. Feedback you send may be used to improve the product without obligation to you.
7. Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." SPEECH RECOGNITION AND TRANSCRIPTION MAY CONTAIN ERRORS. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT WHERE DISCLAIMERS ARE ALLOWED.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA OR PROFITS, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US DIRECTLY FOR ZEN WHISPER IN THE TWELVE MONTHS BEFORE THE CLAIM (EXCLUDING AMOUNTS PAID TO STOREFRONTS SUCH AS GUMROAD WHERE WE DO NOT RECEIVE THEM AS A DIRECT CHARGE), OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), IF SUCH A CAP IS ALLOWED.
9. Governing law
Except where mandatory consumer law requires otherwise, these Terms are governed by the laws of India. Nothing limits rights you may have in your country of residence under mandatory law.
10. Changes
We may update these Terms. We will post the updated version on the Site and revise the "Last updated" date. Continued use after changes take effect constitutes acceptance where the law allows.
